Distance Contract and Website Terms of Use

1. General Terms
- These terms govern the procedure by which the Buyer purchases goods on the website www.sarlotesaudumi.lv, and the procedure by which the Seller accepts, processes, delivers, and fulfils orders.
- By placing an order, the Buyer confirms that they have read these terms, the product description, the price, delivery information, and the withdrawal conditions.
- The distance contract between the Seller and the Buyer is concluded when the Buyer places an order on the website and the Seller has received it for processing.
- The Seller undertakes to sell and deliver the goods to the Buyer in accordance with the confirmed order, and the Buyer undertakes to pay for the goods and the selected delivery.
- These terms apply to the extent that they do not conflict with the laws and regulations in force in the Republic of Latvia.
2. Goods and Information on the Website
- Each product on the website includes its description, price, available variations, and other essential information, where applicable to the specific product.
- Product colours in real life may differ slightly from those shown on the website due to screen, monitor, or device settings.
- Some goods may be manufactured, prepared, cut, or adjusted according to the Buyer’s individual instructions. In such cases, the manufacturing or preparation time is usually 5-9 working days, unless otherwise stated in the product description.
- If a product is available as a pre-order and the product description states PRE-ORDER, the delivery or dispatch time specified in the product description shall apply.
- The Seller may update product descriptions, prices, and availability. Price changes do not affect already confirmed and paid orders, except where the price was stated due to an obvious technical error.
- If the ordered product is unavailable or delivery problems arise, the Seller shall inform the Buyer within one working day or as soon as possible.
3. Ordering Goods
- To place an order, the Buyer selects the product, its quantity, size, length, colour, or other available variation and adds the product to the shopping cart.
- The Buyer is responsible for providing accurate order details, including name, surname, delivery address, telephone number, and email address.
- If the Buyer wishes to change the order details, the Seller must be informed immediately via the contact form or by writing to eksg.sia@gmail.com.
- Changes to the order are possible only if the order has not yet been dispatched, handed over to the delivery service provider, or started for individual manufacture, cutting, or adjustment according to the Buyer’s instructions.
- By ordering a product, the Buyer confirms that they have read the product description, care instructions, and other information published for the respective product.
4. Product Price and Payment
- Product prices are stated for each product. Unless otherwise indicated, prices are shown in euros and include VAT.
- Delivery cost is calculated separately and depends on the Buyer’s selected delivery country and delivery method.
- The Buyer may pay using the payment methods available on the website: bank card, bank transfer, online banking payment, Visa, Mastercard, Shop Pay, Apple Pay, Google Pay, or another payment method offered during checkout.. or another payment method offered at checkout.
- If payment is made by bank transfer, interbank commissions and other costs associated with making the payment shall be borne by the Buyer.
- The invoice is prepared electronically and is valid without a signature.
- Order processing, manufacturing, or dispatch is started after payment is received, unless the Seller and Buyer have agreed otherwise.
5. Delivery of Goods
- The Seller delivers the order to the Buyer according to the delivery method selected by the Buyer.
- In Latvia, delivery to an Omniva parcel machine is usually completed within 1-2 working days.
- For other delivery methods and countries, the estimated delivery time is 3-5 working days.
- If the product is not in the Seller’s warehouse, the Seller dispatches or hands over the product within 5-14 working days from the date payment is received, unless another time limit is stated in the product description.
- In urgent cases, the Buyer may contact the Seller before placing the order to agree on a possible faster dispatch or handover.
Delivery prices
The final delivery price is shown during checkout after selecting the country and delivery method. Prices include VAT.

Free delivery: Delivery to an Omniva parcel machine in Latvia is free for orders from 70,00 €, if this delivery option is selected during checkout.
Availability of DPD parcel machines outside the Baltic States depends on the active collection points in the selected country.
6. Local Pickup and Delivery Terms
- If the Buyer chooses to collect the order in person at Jāņa Poruka iela 23, Cēsis, Cēsu nov., LV-4101, Latvia, the Seller and Buyer shall agree individually on the collection date and time.
- The order must be collected within 3 working days after receiving the notification, unless the Seller and Buyer have agreed otherwise.
- Omniva parcel machines accept shipments weighing up to 30 kg.
- DPD Pickup points and DPD parcel machines accept shipments weighing up to 20 kg per parcel.
- If the product size or weight exceeds the parcel machine limits, only courier delivery or an individually agreed delivery method may be available for the order.
- The courier delivery price does not include carrying the goods above the first floor unless separately agreed.
- If the Buyer wishes to receive the order by another delivery method, this must be agreed with the Seller in advance.
7. Delivery Delays and Uncollected Orders
- If delivery is delayed, the Seller shall inform the Buyer as soon as the delay is identified.
- The Seller is not responsible for delays caused by the delivery service provider’s actions, inaccurate Buyer data, the Buyer’s unavailability, or other circumstances beyond the Seller’s control, to the extent permitted by law.
- If the Buyer does not collect the order within the specified time or it cannot be handed over, the order may be returned to the Seller.
- If the order has been paid for, the Seller will contact the Buyer to agree on redelivery or cancellation of the order.
- Redelivery costs may be charged additionally.
- If the order is cancelled due to non-collection or non-handover, the Buyer shall be refunded the amount paid for the goods. The refund may be reduced by actually incurred delivery, return, or other costs associated with non-collection of the order, if such deduction is applicable under the laws and regulations.
8. Right of Withdrawal and Returns
- A Buyer who is a consumer has the right to withdraw from the distance contract within 14 days from the date of receipt of the product, without stating a reason.
- To exercise the right of withdrawal, the Buyer must inform the Seller before the expiry of the withdrawal period by writing to eksg.sia@gmail.com or using the contact form.
- The Buyer may use the withdrawal form, but its use is not mandatory if the Buyer clearly declares the intention to withdraw from the contract.
- After notifying withdrawal, the Buyer must send or hand over the product to the Seller without undue delay and no later than 14 days.
- The product must be unused, undamaged, and kept in the condition in which the Buyer received it, insofar as this is necessary to inspect the product’s nature, characteristics, and functioning.
- The Buyer is responsible for any decrease in the value of the product if the product has been used more than is necessary to determine its nature, characteristics, and functioning.
- The costs associated with returning the product in the event of exercising the right of withdrawal shall be borne by the Buyer, except where the product is damaged, does not comply with the contract terms, or the Seller has delivered the wrong product.
- The Seller shall refund the payments received from the Buyer in accordance with the procedure prescribed by law, no later than 14 days from the day the withdrawal notice is received. The Seller may withhold the refund until the product has been received back or the Buyer has provided proof of return shipment.
Products for which the right of withdrawal may not apply
- The right of withdrawal does not apply to products made according to the Buyer’s individual instructions or clearly personalised.
- The right of withdrawal may not apply to fabrics, ribbons, materials, or other goods that, at the Buyer’s choice, have been cut, measured, or prepared in a specific length, quantity, or set.
- The right of withdrawal does not apply to packaged goods that, after delivery, have been opened and are not suitable for return for health protection or hygiene reasons.
- These restrictions do not affect the Buyer’s right to make a claim regarding damaged goods or goods that do not comply with the contract terms.
9. Non-Conformity, Damage, and Complaints
- If the Buyer receives damaged, incorrect, or non-compliant goods, the Buyer must contact the Seller by writing to eksg.sia@gmail.com and indicate the order number, a description of the problem, and, if possible, attach photographs.
- The consumer has the right to make a claim regarding non-conformity of the product with the contract terms within 2 years from the date of receipt of the product.
- Upon receiving the order, the Buyer must inspect the external condition of the shipment and packaging. If the packaging is damaged, wet, wrinkled, torn, or otherwise externally damaged, the Buyer must note this in the delivery document, if one is signed, and inform the Seller as soon as possible.
- If a product non-conformity or manufacturing defect is identified, the Seller shall resolve the matter in accordance with the laws and regulations, offering an appropriate solution: repair, replacement, price reduction, refund, or another solution provided for by law.
10. Product Exchange
- Product exchange is possible by individual agreement with the Seller, if the product has not been used, damaged, or prepared according to the Buyer’s individual instructions.
- If the exchange is not related to a product defect or the Seller’s error, the costs of redelivery and return shall be borne by the Buyer.
- Goods may also be handed over for exchange or return in person at Vilku iela 12 - 64, Cēsis, Cēsu nov., LV-4101, Latvia, by prior arrangement.
11. Website Content and Intellectual Property
- The website content, including texts, photographs, design, product descriptions, and other materials, is the property of the Seller or its partners.
- Any republication, copying, use of website content for commercial purposes, or distribution without the Seller’s written consent is prohibited.
- All rights reserved.
12. Personal Data Processing
- The Seller processes the Buyer’s personal data in order to accept and fulfil orders, prepare invoices, ensure delivery, communicate with the Buyer, and fulfil obligations established by law.
- The following data may be processed for order fulfilment: name, surname, email address, telephone number, delivery address, invoice data, and order information.
- The website is operated on the Shopify platform. The Buyer’s data may be transferred to Shopify and other service providers necessary for order processing, payments, delivery, and website operation.
- The Buyer’s data are not sold to third parties.
- The Buyer has the right to access their data, request rectification, deletion, restriction of processing, object to processing, and withdraw consent where processing is based on consent.
- More detailed information on personal data processing is available in the Privacy Policy, if published separately.
13. Liability
- The Seller is not liable for losses arising from incorrectly provided Buyer data, uncollected shipments, or the Buyer’s unavailability.
- The Seller is not liable for delivery delays caused by the fault of the delivery service provider or circumstances beyond the Seller’s control, to the extent permitted by applicable law.
- The risk of accidental loss or damage to the goods passes to the Buyer at the moment the goods are handed over to the Buyer, to a person designated by the Buyer, or to the collection point specified by the delivery service provider, to the extent permitted by applicable law.
14. Dispute Resolution
- All questions and complaints shall first be resolved by contacting the Seller by email at eksg.sia@gmail.com.
- The Seller shall review the Buyer’s submission and respond as soon as possible, in accordance with applicable laws and regulations.
- If the dispute cannot be resolved by mutual agreement, the Buyer may contact the Consumer Rights Protection Centre or use other dispute resolution methods provided for by law.
- These terms are governed by the laws and regulations of the Republic of Latvia.
